Mobile App Terms & Conditions

App Name: Mobile app (SDS) Sell Deliver Service for SAP LMD
Provider: White Castle Consulting, LLC, a GA/USA llc
These Terms and Conditions (“Terms”) govern the use of the Mobile app (SDS) or mobile application (the “App”) by authorized users of a customer (“Customer”) who has entered into a direct written agreement (the “Enterprise Agreement”) with White Castle Consulting, llc (“Company,” “we,” “us,” or “our”). In the event of a conflict between these Terms and the Enterprise Agreement, the Enterprise Agreement controls.
- LICENSE AND ACCESS
We grant the Customer and its authorized employees, contractors, or agents (“Users”) a non-exclusive, non-transferable license to access and use the App solely for the Customer’s internal business operations and subject to the Enterprise Agreement.
- AUTHORIZED USERS
Users must:
- Be designated and provisioned by the Customer;
- Use the App only for purposes permitted under the Enterprise Agreement;
- Maintain the confidentiality of login credentials and immediately report any unauthorized access.
- PROHIBITED USES
Users may not:
- Reverse engineer, disassemble, or decompile any part of the App;
- Use the App in violation of applicable laws or export regulations;
- Introduce malware, disrupt networks, or overload system resources;
- Use the App for any personal, consumer, or non-enterprise purpose.
- DATA PRIVACY AND SECURITY
All data collected or processed via the App is handled in accordance with the Company’s Privacy Policy (Link) and the data processing terms of the Enterprise Agreement. We implement appropriate administrative, technical, and physical security controls.
- THIRD-PARTY SERVICES
The App may interoperate with third-party services (e.g., identity providers, analytics tools). Customer and Users are responsible for compliance with those third-party terms.
- INTELLECTUAL PROPERTY
All rights, title, and interest in and to the App and all related IP (including updates, derivatives, and improvements) remain the exclusive property of White Castle Consulting, LLC. No rights are granted except as explicitly set forth herein or in the Enterprise Agreement.
- AVAILABILITY AND SUPPORT
The App is provided as part of the services under the Enterprise Agreement. Availability and support terms are governed by the applicable SLA or support addendum.
- TERMINATION AND SUSPENSION
Access to the App may be suspended or terminated:
- As directed by the Customer;
- Upon expiration or termination of the Enterprise Agreement;
- If there is a breach of these Terms or applicable laws.
- COMPLIANCE WITH EXPORT LAWS
The App and any associated software or documentation may be subject to U.S. and international export laws and regulations. You agree not to use, export, or re-export the App except in compliance with all applicable export laws, including the Export Administration Regulations (EAR). The App may have an Export Control Classification Number (ECCN) of [Insert ECCN, if known].
- DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- LIMITATION OF LIABILITY
Subject to the Enterprise Agreement:
- We are not liable for indirect, incidental, or consequential damages;
- Our total liability arising out of or in connection with the App is limited to the amount paid under the Enterprise Agreement in the preceding 12 months.
- MODIFICATIONS
We may update the App or these Terms from time to time. Material changes will be communicated to the Customer. Continued use after such updates constitutes acceptance by the Customer’s authorized Users.
- GOVERNING LAW
These Terms are governed by the laws and jurisdiction specified in the Enterprise Agreement.
